1. If I lodge a report, will my information be kept confidential?

Yes. Your information will be kept confidential and will not be disclosed to outsiders. However, based on our experience, the person being reported will suspect those close to him. For example accusations will be made to family members who have quarreled with him, advised him and so on.

2. Will people with drug addiction problems (suspects) know me as the one who lodges a report?

No, we will always maintain your confidentiality as the one who lodges a report.

3. If I lodge a report, can my son be admitted directly to the Rehabilitation Center (PUSPEN) until he completes the rehabilitation process?
I worry if my son is detained and then released the next day he would be furious and angry at me as well as other family members.

Based on the provisions of the law, the order to send a prison into a Rehabilitation Center (PUSPEN) or to undergo rehabilitation in the community is under the jurisdiction of the court with the recommendation of AADK officer. AADK also needs to carry out several processes before bringing a person suspected of being an addict to the court. AADK needs to get drug confirmation test results from the pathology laboratory and confirmation from the medical doctor that the person is in fact an addict before taking him to the court. This process may take 2 weeks or more depending on the type of drug taken. Before the laboratory result is obtained, the person may be granted a bail by AADK officer. If the person being reported or threatening the safety of himself runs rampage or is the or others, you can directly contact the police for runs rampage immediate action.

4. My family has lodged a report regarding one of the family members being involved with drug addiction. However, after being remanded, he returned home after 14 days. Why was he only detained for 14 days?

Based on the provisions of the law, a person suspected of being a drug addict, can be detained under section 3 (1) of the Drug Dependants (Treatment and Rehabilitation) Act 1983 within 24 hours for the purpose of performing a drug screening test while waiting for the result of drug confirmation test administered by pathology laboratory the person may be remanded up to 14 days.
The person has to be released after a period of 14 days because AADK does not have the authority to hold him more than that period. If the result of the pathology laboratory test is still not obtained from MOH, the person will be released on bail by AADK officer.
The public perception that AADK releases cases after detention is inaccurate. This is because whenever the pathology laboratory results are not obtained during the remand period, they need to be released. However, their cases are still pending until the pathology laboratory reports are obtained. If the laboratory reports indicate drug positive results and the medical doctor confirms them as drug dependants, they still have to appear in court according to the date that has been given for the purpose of obtaining an order (entry into a rehabilitation center or supervision in the community).

5. One of my family members is a person undergoing supervision by AADK. I found out that he is still involved with drug abuse. Can he be placed in any Rehabilitation Center (PUSPEN) again?

Based on the provision of the law, Person Under Supervision (OKP) under the supervision of AADK must comply with the conditions of supervision prescribed. Any activity that violates any of the six (6) conditions set can be construed as violating the conditions of supervision under Section 6 (2) of the Drug Dependants (Treatment and Rehabilitation) Act 1983. AADK will investigate the violation before the case is charged in court. If convicted, the person (OKP) can be punished under Section 6 (3) Drug Dependants (Treatment and Rehabilitation) Act 1983 which is imprisonment not exceeding 3 years, or whipping not exceeding 3 strokes or both.
OKP who is still under the supervision of AADK cannot be readmitted to the Rehabilitation Center (PUSPEN).

6. I worry about my safety if I lodge a report. Will I be safe if I lodge a report related to drug abuse to AADK?

All reports related to drug abuse made to AADK are categorized as confidential. The privacy and data of the one who reports will be kept confidential and will not be passed on to any third party or the party being reported. AADK guarantees the confidentiality of the one who reports.

7. My son was once admitted to a Drug Rehabilitation Center and has completed the rehabilitation program. Why is he still on drugs?

Recovery from addiction is a lifelong process because drug addiction is a chronic relapsing disease. Ex-drug addict is prone to relapse and return to drug abuse and addiction if he does not carefully observe his steps. Upon complation of rehabilitation in institution, he needs contonous help and support to maintain his recovery. He is required to be under the supervision of the District AADK for a centair period of time and participate in the treatment and rehabilitation programs implemented by the District AADK. Support from immediate family, friends and local neighbors is very important to prevent the client from re-engaging with drugs.

8. Why is someone who is detained and found drug positive during drug screening test granted bail by AADK officers?

AADK only considers granting bail to detainee who has chronic diseases that is not suitable for remand. Apart from that, all detainees will be brought to court to obtain remand order. The remand order and period are subject to the Magistrateโ€™s discretion. Typically, detainees who are found positive methamphetamine during drug screening test are released on bail as pathology laboratory results cannot be obtained within the remand period (14 days). The laboratory results are important in obtaining court order for detainees to undergo a process of treatment and rehabilitation in the institution or community.

9. Why does AADK release a drug addicts after detaining him in a lock up if he could be directly sent to a Rehabilitation Center (PUSPEN)?

10. Why didn’t AADK arrest  drug dealers instead of keeping on arresting addicts?

Based on the provision of law and coordination of duties between AADK and PDRM, AADK will conduct arrests and detentions related to drug addiction (demand reduction).  PDRM on the otherhand, is focusing on drug trafficking (supply reduction) issues, including drug dealers. However, if AADk receives information or reports related to drug trafficking or dealers the information will be channeled to the PDRM.

11. How long does it take before I receive feedback on my complaint?
